    Shipping, Returns & Cancellations Policy

    This policy applies to all products and services provided by Life X DNA™. By purchasing from us, you agree to the terms below, in addition to our Terms of Service.

    1. Shipping

    1.1 Where we ship

    • Australia & New Zealand only.

    1.2 Carriers & tracking

    • Orders are shipped via Australia Post (AU) and NZ Post (NZ) with tracking.
    • Tracking details are emailed when your order is dispatched.

    1.3 Dispatch time

    • Orders placed before 12:00 AWST are typically dispatched within 1–2 business days (excluding weekends and WA public holidays).

    Delivery timeframes (guideline)

    • Australia (metro): 2–6 business days
    • Australia (regional/remote): 3–10 business days
    • New Zealand: 5–10 business days
      Actual delivery times may vary by carrier, weather, and location.

    1.5 Shipping fees

    • Displayed at checkout and calculated based on destination and service level.

    1.6 Incorrect addresses / undeliverable parcels

    • If a parcel is returned due to an incorrect or incomplete address, refusal, or failure to collect, we can reship once the additional postage is paid.
    • Title and risk pass on delivery to the address provided at checkout.

    1.7 Damaged, missing or lost in transit

    • Please notify us within 21 days (AU) or 14 days (NZ) of the expected delivery date if your kit arrives damaged or has not arrived.
    • We’ll investigate with the carrier and, once confirmed, arrange a replacement at no cost.

    2. Returns (Unopened Kits)

    • Change-of-mind returns accepted on unopened kits within 30 days of purchase for a full refund of the product price.
    • The kit must be in original, resaleable condition and packaging.
    • Return postage is the customer’s responsibility; we recommend tracked postage.
    • To start a return: email evolve@lifexdna.com with your order number and reason for return. We’ll issue return instructions.

    3. Cancellations (Opened Kits, Not Yet Submitted)

    If your kit has been opened but no DNA sample has been submitted to the lab, you may cancel your order. A$200 processing fee applies (covers kit, distribution, activation and system setup).

    4. Replacement Kits (Incomplete or Incorrect Samples)

    If your DNA sample is not completed correctly or otherwise can’t be processed, a A$200 replacement fee applies to cover a new kit and re-shipping. Please follow the kit instructions carefully to avoid delays and costs.

    5. Non-Returnable / Non-Refundable Items

    • Any kit where a DNA sample has been used/submitted for processing.
    • Services already delivered or commenced (e.g., data analysis, report generation, or consultations once booked and completed).

    6. Consultations & Bookings (if included with your pack)

    • You may reschedule with ≥24 hours’ notice at no charge.
    • Late cancellations (<24 hours) or no-shows may be charged a A$50 rebooking fee.

    7. Refund Processing

    • Refunds are issued to the original payment method once the returned kit is received and inspected.
    • Please allow 5–7 business days for processing, plus your bank’s clearance time.

    8. Your Consumer Rights

    Nothing in this policy limits your rights under the Australian Consumer Law (AU) or applicable New Zealand consumer law. If a product is faulty, not fit for purpose, or not as described, we will provide the appropriate remedy in line with those laws.

    OVERVIEW

    This website is operated by Life X DNA Australia (“Life X DNA”, “we”, “us”, “our”). Life X DNA offers this website, including all information, tools, and services available from this site to you, the user, conditional upon your acceptance of all terms, conditions, policies, and notices stated here (collectively, the “Terms”).

    By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms, including any additional terms and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content

    Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, then you may not access the website or use any services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of, or access to, the website following the posting of any changes constitutes acceptance of those changes.

    Our store is hosted on WooCommerce, which provides the e-commerce platform that allows us to sell our products and services to you.

    SECTION 1 – ONLINE STORE TERMS

    By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory (Australia) or region/province (New Zealand) of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependants to use this site.

    We reserve the right to refuse service to anyone, for any reason, at any time.
    You understand that your personal content (excluding payment card data and excluding any genetic data), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer over networks.
    You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without our express written permission.
    Headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

    SECTION 3 – ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

    We use high-quality genomic technologies and quality controls. However, no technology is error-free, and we do not guarantee that any data or interpretation will be perfectly accurate or suitable for every purpose.
    Material on this website is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.
    This site may contain certain historical information for reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update information. You agree it is your responsibility to monitor changes.

    SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES

    Prices for our products are subject to change without notice.
    We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.
    We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

    SECTION 5 – PRODUCTS OR SERVICES

    Certain products or services may be available exclusively online. These may have limited quantities and are subject to return or exchange only according to our Returns Policy.
    We have made every effort to display as accurately as possible the colours and images of our products. We cannot guarantee that your device’s display of any colour will be accurate.
    We reserve the right—but are not obligated—to limit the sales of our products or Services to any person, geographic region, or jurisdiction, and to limit quantities. All descriptions and pricing are subject to change at any time without notice. We may discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
    We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

    SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

    We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order (including orders placed under the same account, the same card, and/or the same billing or shipping address). If we change or cancel an order, we may attempt to notify you via the e-mail and/or billing address/phone number provided at the time the order was made.
    You agree to provide current, complete, and accurate purchase and account information for all purchases, and to promptly update your details so we can complete transactions and contact you as needed.

    SECTION 7 – OPTIONAL TOOLS

    At present, we do not offer any optional third-party tools or integrations on this website.
    If we introduce any optional tools in the future, they will be clearly identified and entirely optional to use. Any such tools would be provided “as is” and “as available” by the relevant third-party provider, and your use would be subject to that provider’s own terms and privacy notice. To the maximum extent permitted by law, we are not responsible for, and accept no liability for, any act or omission of such third-party providers.

    SECTION 8 – THIRD-PARTY LINKS

    We do not use third parties of any kind to provide our content, analytics, marketing, fulfilment, or data processing other than the following providers essential to operating this website:

    1. WooCommerce – our e-commerce platform; and
    2. Our payment service provider – to securely process card and other payments.
      We do not otherwise host, embed, or endorse third-party content, nor do we direct you to third-party websites as part of purchasing or using your account on our site. If we ever offer optional links or tools in the future, they will be clearly identified and subject to their own terms.
      Your use of WooCommerce and our payment processor is subject to those providers’ own terms and privacy notices. To the maximum extent permitted by law, we are not responsible for, and shall not be liable for, any act or omission of those providers. Queries or complaints about payment processing should be directed to the payment provider.

    SECTION 9 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

    If, at our request, you send certain submissions (e.g., contest entries) or without a request you send creative ideas, suggestions, proposals, plans, or other materials (collectively, “comments”), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you forward to us. We are under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
    We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion is unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms.
    You agree that your comments will not violate any right of any third party, including copyright, trade mark, privacy, personality, or other personal or proprietary right; will not contain libellous or otherwise unlawful, abusive, or obscene material; and will not contain any virus or malware. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments.     Your submission of personal information through the store is governed by our Privacy Policy (available on our website).

    Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability). We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
    We undertake no obligation to update, amend, or clarify information, including pricing information, except as required by law. No specified update or refresh date should be taken to indicate that all information has been modified or updated.

    In addition to other prohibitions set forth in the Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, state/territory, or local laws or regulations; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent security features of the Service or any related website. We reserve the right to terminate your use of the Service for violating any prohibited uses.

    We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free.
    You agree that from time to time we may remove the Service for indefinite periods or cancel the Service at any time, without notice.

Except as expressly stated by us in writing, the Service and all products and services delivered through the Service are provided “as is” and “as available”, without any representations, warranties, or conditions of any kind, whether express or implied, including implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, durability, title, and non-infringement.
    To the fullest extent permitted by law, in no case shall Life X DNA Australia, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, savings, data, or replacement costs, arising from your use of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including errors or omissions in any content, or any loss or damage incurred as a result of use of the Service or any content posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Where liability cannot be excluded under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993, our liability is limited to the minimum extent permitted by law.

    SECTION 14 – INDEMNIFICATION

    You agree to indemnify, defend, and hold harmless Life X DNA Australia and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable solicitors’/attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

    SECTION 15 – SEVERABILITY

    If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed. This shall not affect the validity and enforceability of any other remaining provisions.

    SECTION 16 – TERMINATION

    Obligations and liabilities incurred prior to the termination date shall survive termination for all purposes.
    These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our site.
    If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or we may deny you access to our Services (or any part thereof).

    SECTION 17 – ENTIRE AGREEMENT

    The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
    These Terms and any policies or operating rules posted by us on this site or in respect of the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written.
    Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

    These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia. For New Zealand consumers, mandatory consumer protections under New Zealand law apply in addition to these Terms.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website.     Our Services and reports are for information and educational purposes only. We do not provide medical, diagnostic, or treatment services, and our content is not a substitute for professional medical advice, diagnosis, or treatment.

    Return & Refund Policy – August 2025

    OVERVIEW

    This Return & Refund Policy applies to all products and services supplied by Life X DNA™ in Australia and New Zealand. By purchasing from us, you agree to the terms below, in addition to any terms in our Terms of Service. Nothing in this policy limits your rights under the Australian Consumer Law (ACL) or New Zealand’s Consumer Guarantees Act 1993 (CGA).

    1) Change-of-Mind Returns (Unopened Kits)

    • You may return unopened DNA kits within 30 days of purchase for a full refund.
    • Kits must be in original condition and packaging, with all components included.
    • Return postage is the client’s responsibility (unless required by law).
    • To start a return, email evolve@lifexdna.com to obtain a Return Authorisation (RMA). Unauthorised returns may be refused.

    2) Cancellations (Opened but Unused Kits)

    If your kit has been opened but:

    • the sample has not been collected, and
    • the kit has not been registered online, and
    • no sample has been submitted to the laboratory,
      you may cancel your order subject to a AU$200 processing fee (covers kit distribution, materials, and system setup).

    3) Replacement Kits (Incorrect or Incomplete Samples)

    If a sample collection is incorrect, incomplete, contaminated, or otherwise unsuitable for processing, we can supply a replacement kit for AU$200 to cover replacement and re-shipping costs. Please follow the kit instructions carefully to avoid delays.

    4) Damaged, Defective, or Missing Items

    • If your kit arrives damaged, defective, or incomplete, contact us within 7 days of delivery with photos and your order number. We’ll replace it at no cost once verified.
    • If your order is lost in transit or tracking shows non-delivery, we’ll investigate and send a replacement where appropriate.

    5) Non-Returnable / Non-Refundable Items

    For privacy, chain-of-custody, and biosecurity reasons, we cannot accept returns or issue refunds once any of the following has occurred:

    • The sample has been collected, registered online, submitted to the laboratory, or processing has commenced.
    • Digital reports, data access, or consultations have been delivered (in whole or part).
      This does not affect your rights under the ACL/CGA where applicable.

    6) Cancellations Before Dispatch

    7) Shipping Fees & Duties

    Original shipping charges are non-refundable unless we are at fault (e.g., wrong item shipped or DOA/faulty). Any return shipping costs are the client’s responsibility unless required by law.

    8) Refund Method & Timing

    Approved refunds are issued to the original payment method. Please allow 5–10 business days after we receive and inspect returned goods (or after approval for a pre-dispatch cancellation).

    9) How to Start a Return or Cancellation

    • Order number, full name, and contact details
    • Reason for return/cancellation
    • Photos if the kit is damaged or defective
      We’ll reply with next steps and, if relevant, an RMA and return instructions. Please do not send returns to our office without an RMA.

    10) Statutory Rights (AU/NZ)

    You may be entitled to remedies (repair, replacement, refund) under the ACL (Australia) or CGA (New Zealand) for goods or services that fail to meet consumer guarantees. Where a failure is major, you are entitled to choose a refund or replacement. Where a failure is minor, we will promptly repair or replace.

    Life X DNA™ (“we”, “us”, “our”) respects your privacy. This policy sets out how we collect, use, disclose, secure, and retain your information when you visit www.lifexdna.com (the Site) or use our services (the Services). We give special protection to genetic and health information.

    1. Who we are and scope

    We are a privately owned Australian company headquartered in Perth, with operations in Australia and New Zealand. This policy applies to personal information we handle as a controller (or APP entity under Australian law), including information provided by clients, website visitors, and prospective clients. If you access our Services from New Zealand, see Section 11 for NZ-specific information.

    2. Our compliance framework

    We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), including the Notifiable Data Breaches scheme. Where relevant, we also take into account applicable state/territory health privacy laws (e.g., NSW Health Records and Information Privacy Act 2002; VIC Health Records Act 2001; ACT Health Records (Privacy and Access) Act 1997).

    Given our New Zealand operations, we also comply, where applicable, with the Privacy Act 2020 (NZ) and the Health Information Privacy Code 2020 (NZ).

    We do not rely on the lapsed Genetic Privacy and Non‑Discrimination Bill 1998. Instead, we treat genetic information as sensitive information under the Privacy Act 1988 (Cth) and apply elevated protections.

    3. The information we collect

    3.1 Account & Order Information

    Name, email, phone, billing and delivery addresses, order details, payment confirmation (processed by our payment providers), communications and support tickets.

    3.2 Device & Usage Information

    When you visit the Site, we automatically collect technical data (IP address, time zone, browser type/version, referring pages), pages viewed, links clicked, and cookie identifiers. We use cookies, tags, pixels and log files to operate and improve the Site (see Section 8).

    3.3 Self‑Reported Information (optional)

    If you choose, you may provide demographic and health‑related details (e.g., age, sex, family medical history, lifestyle, ethnicity) to enhance report precision. This is strictly optional.

    3.4 Genetic & Health Information

    We do not accept uploads of external genetic data files. Your genetic material is collected using our at‑home collection kit (e.g., saliva or cheek swab). Life X DNA performs sequencing and analysis using coded barcodes only (no given names on any sample or instrument run). Once sequencing is complete, the physical sample is irreversibly destroyed by us. We store the resulting Genetic Information (digital data) in encrypted repositories and generate your Life X DNA™ insights.

    4. How we collect information

    • Directly from you: account creation, orders, consultations, forms, email/phone.
    • Automatically: cookies and similar technologies when you use the Site.
    • From service providers: e.g., payment processors, analytics, couriers/logistics for kit delivery and return; these providers do not receive your Genetic Information.

    5. How we use information

    We use personal information to:

    • Provide, personalise and improve the Services and your reports;
    • Process orders and payments; dispatch kits; send confirmations and updates;
    • Provide support and respond to enquiries;
    • Maintain security, prevent fraud and misuse;
    • Operate, test and enhance our analytics and AI systems (using de‑identified/aggregated data wherever feasible);
    • Comply with legal/regulatory obligations and maintain business records.

    We do not sell your personal information. We never use your Genetic Information for advertising.

    Ownership & control of Genetic Information: You retain ownership of your Genetic Information and may request deletion at any time (see Section 9).

    6. Sharing and disclosure

    We do not sell or rent personal information. We place additional restrictions on Genetic Information:

    • No internal access to sequencing files: Life X DNA does not have access to clients’ raw genetic sequencing files (e.g., FASTQ/BAM/VCF or equivalent). These files are barcoded and blockchain‑encrypted. They can only be accessed and decrypted by the client via their secure portal/credentials.
    • Sequencing files cannot be disclosed: We cannot provide sequencing files, even when legally required. Only the client can access/decrypt these files.
    • Pseudonymisation & non‑identifiability: Sequencing artefacts and derived datasets are labelled only with barcodes. They contain no names or contact details and cannot be used to identify clients.
    • Processing model: Our systems process barcoded data to generate your Life X DNA™ insights. Our personnel may access operational metadata only (e.g., kit status, barcode, timestamps) to deliver support and fulfilment—not raw sequencing files. We do not disclose Genetic Information to third parties without your explicit consent. If disclosure is mandated by law, see Legal/compliance below; note we cannot provide sequencing files in any circumstances.
    • Operational vendors – non‑genetic data only: We use service providers for e‑commerce, hosting/backup, email, analytics and logistics for account, order and site usage data only (e.g., name, contact details, delivery address, order ID). These providers are bound by confidentiality and data processing terms. Couriers receive only the details required to deliver and return kits.
    • Payments: Card and other payments are processed by third‑party providers; we do not store full card or bank details on our servers.
    • Employers/insurers: We will never share your personal or Genetic Information with an employer, insurer or similar third party.
    • Research & analytics: Any internal research, service improvement or model training uses de‑identified and/or aggregated information; no identifiable Genetic Information is disclosed outside Life X DNA.
    • Legal/compliance: We cannot provide sequencing files; only the client can access these.

    7. Security

    We apply administrative, technical and physical safeguards proportionate to the sensitivity of the data, including encryption in transit and at rest, role‑based access controls, network segmentation, secure key management, and audit logging. Genetic and health data are stored in encrypted repositories. Where feasible, we maintain offline/cold‑storage archives for Genetic Information.

    Although no system can be 100% secure, we operate a risk‑based security programme and comply with the Notifiable Data Breaches scheme in Australia and comparable obligations in New Zealand where applicable.

    • Sample destruction: physical reference samples are destroyed after sequencing by Life X DNA.

    You may request deletion of your account and Genetic Information at any time. We will action deletion subject to lawful retention requirements (e.g., invoices). We will confirm once deletion is complete.

    9. Cookies and similar technologies

    We use cookies and similar tools to:

    • keep you signed in and remember preferences;
    • analyse Site performance and usage;
    • measure marketing effectiveness.

    Do Not Track: our Site does not currently respond to browser DNT signals.

(Where testing for a minor is arranged, we require verifiable parental/guardian consent via our client onboarding process.)

    The information in the reports provided by BRAIN LABS to you will receive has not been evaluated by the Therapeutic Goods Administration (TGA Australia) or any other official medical body.
